Terms and Conditions
Updated on 17 October 2026.
1. Seller identification
The Home Made Nest online store, available at https://homemadenest.com, is operated by Anabela da Silva Fernandes, Portuguese tax number (NIF) 114669376, with business premises at Praceta Dr. Vieira de Araújo, no. 2, Centro Comercial Rio Lima, Shop 29, 4990-112 Ponte de Lima, Viana do Castelo, Portugal. Email: homemadenest.craft@gmail.com. Telephone: 963 636 363 (call to a Portuguese mobile network).
2. Scope
These Terms and Conditions govern purchases made through the Home Made Nest store. The store may sell physical goods, items made to the consumer’s specifications or clearly personalized, digital content not supplied on a tangible medium and, where indicated, usage rights/licences associated with digital content.
3. Product information
The essential characteristics, price, included contents, format, dimensions, materials, personalization options, estimated preparation time and other relevant information will be stated on each product page. For digital content, the format, resolution, dimensions, functionality, compatibility, interoperability and any technical limitations will be stated where relevant. Images are presented as accurately as possible; handmade products may have small variations inherent to manual production, without prejudice to the obligation to conform to the contract.
4. Prices and taxes
Prices shown in the store are in euros and include applicable taxes. Before the order is completed, the customer will be informed of the total price, including taxes and, where applicable, transport, delivery, shipping or other charges. Consumers will not be bound by additional charges that were not duly disclosed and accepted in accordance with the law.
5. Ordering process
The customer selects the products, variants and desired personalization options, reviews the cart and the information entered and, before submitting the order, may identify and correct input errors using the tools provided by the store. The purchase process will clearly indicate when placing the order entails an obligation to pay. The languages available for contracting will be identified in the store.
6. Order confirmation and contract
After the order is completed, the customer will receive confirmation of the distance contract as required by law. If the pre-contractual information was not previously provided on a durable medium, confirmation will be provided on such a medium within five days of the contract being concluded and, at the latest, when the goods are delivered or before the service begins.
7. Payment
Available payment methods are shown at the start of the ordering process and at checkout. Preparation, production and dispatch begin after payment has been confirmed and the necessary information has been received.
8. Availability and performance
Unless otherwise agreed with the consumer or a specific period is stated for the product, the order will be fulfilled within the applicable statutory period. If a product becomes unavailable and the order cannot be fulfilled, the customer will be informed and statutory refund obligations will apply. The preparation time for personalized or made-to-order items will be stated on the product page.
9. Delivery of physical goods
Delivery areas, any geographical restrictions, available methods, costs and estimated times will be shown before the purchase is completed. Risk relating to the goods transfers to the consumer as provided by law. The customer must provide complete and accurate delivery details. In-stock items are generally dispatched within three business days after payment confirmation. Dispatch is not the same as the carrier’s delivery time. Personalized items follow the specific period agreed after payment, receipt of information and any required approval. Shipping is free on orders of €150 or more, only to mainland Portugal and for orders weighing up to 20 kg.
10. Right of withdrawal — non-personalized physical goods
For distance contracts concerning goods covered by the right of withdrawal, consumers generally have 14 days to withdraw from the contract without giving a reason, with the period calculated as provided by law. The decision must be communicated by an unequivocal statement; the statutory withdrawal form may be used. After giving notice, the consumer must return the goods within the statutory period. Direct return costs are borne by the consumer if the consumer was informed of this beforehand, unless Home Made Nest agrees to bear them or the law provides otherwise. See the returns and refunds policy.
11. Refund after withdrawal
Where the right of withdrawal is validly exercised, Home Made Nest will issue refunds due under the law within the period and on the terms laid down by applicable legislation. In cases provided for by law, we may withhold the refund until the returned goods have been received or the consumer has provided proof that they were sent.
12. Personalized goods
Unless otherwise agreed, the right of withdrawal does not apply, as provided by law, to goods made to the consumer’s specifications or clearly personalized. This exception does not remove consumer rights where the goods are non-conforming, defective, damaged due to an act attributable to the seller, or do not match the order.
13. Digital content and commencement of supply
Products identified as digital are supplied in digital format and do not involve delivery of physical goods, unless expressly stated otherwise. If the customer asks for paid digital content to be supplied during the withdrawal period, prior express consent to begin supply and acknowledgement that this consent entails losing the right of withdrawal when performance begins under the conditions laid down by law will be obtained where legally required. The contractual confirmation will retain the information required by law.
14. Conformity of digital content
Exclusion or loss of the right of withdrawal does not affect the consumer’s statutory rights in the event of digital content not conforming to the contract. If a file is corrupted, incomplete or does not match the agreed characteristics, the rights and remedies provided by consumer-protection legislation on digital content and services will apply.
15. Conformity and statutory guarantee for goods
Goods sold by Home Made Nest benefit from the applicable statutory conformity rights. The store’s commercial policy does not limit or replace those rights. For new movable goods, the seller is liable, as provided by law, for lack of conformity that becomes apparent during the applicable statutory period, currently three years from delivery, without prejudice to specific rules laid down by law.
16. Personalization and proof approval
Personalized products must be paid for in full before work begins. The price, contents, materials, dimensions, production time and number of included revision rounds are set out on the product page or in the quotation accepted by the customer. Where a proof is provided, production depends on its approval. The customer must check names, dates, text, photographs and other information submitted or approved, without prejudice to Home Made Nest’s responsibility for errors attributable to it. Such errors will be corrected free of charge and will not count towards revision rounds. Additional changes will be quoted and will proceed only after the price has been accepted in advance.
After attempts to make contact, 30 consecutive days without a response may lead to the project being suspended and archived. After a final notice, 60 consecutive days without contact may lead to closure of the project. Paid amounts will be dealt with taking into account the work actually completed, legitimately incurred costs and the customer’s mandatory rights; the entire amount is not automatically forfeited for lack of response.
17. Intellectual property and licences
Purchasing digital content does not transfer intellectual-property rights in the work unless expressly stated otherwise. The customer receives only the usage rights set out in the licence applicable to the product. Resale, redistribution, sharing or making the original files available outside the limits of the licence granted is prohibited. Specific personal or commercial-use conditions are stated in the licence associated with the product.
18. Complaints and Complaints Book
Support requests and complaints may be sent to homemadenest.craft@gmail.com or to the business address above. The Portuguese Electronic Complaints Book is available at www.livroreclamacoes.pt.
19. Alternative dispute resolution for consumer disputes
In the event of a consumer dispute, the consumer may refer the matter to CIAB — Consumer Information, Mediation and Arbitration Centre (Consumer Arbitration Tribunal), within its jurisdiction. Updated information and contact details: ciab.pt/contactos. This information does not constitute a declaration of voluntary membership. It does not affect recourse to other competent bodies or the courts as provided by law.
20. Data protection
Personal data collected in connection with orders and use of the store will be processed in accordance with the Home Made Nest Privacy Policy and applicable data-protection legislation.
21. Applicable law and mandatory consumer rights
These Terms are governed by Portuguese law, without prejudice to applicable mandatory consumer-protection rules, including where the consumer resides in another country and applicable law grants protection that cannot be waived by agreement. Nothing in these Terms is intended to exclude or limit rights granted to consumers by mandatory law.
22. Amendments to the Terms
Home Made Nest may update these Terms to reflect legal, technical or operational changes. The version applicable to each order is the one in force and made available to the customer when the contract is concluded, without prejudice to changes required by law.
